TERMS & CONDITIONS

A seat is a digital collectible and an entry to a game we operate. It is not an investment, a security, a share in any business, a fund, a deposit, a currency, or a promise of income, appreciation or resale value. Nothing on this site is an offer, solicitation or invitation to buy or subscribe for anything in any jurisdiction, and nothing on it is financial, investment, legal or tax advice.

You must be at least 18, or the age of majority where you live if that is higher, to mint, hold a seat, take part or receive anything.

Every book in this game is paper. No account is opened, no order is placed, no asset is bought or sold, and no money of yours is traded, held or put at risk by the game. The $100,000 a seat runs is a notional figure used for scoring and nothing else.

Prices come from third parties, may be delayed, wrong or unavailable, and are used as received. Where the rules let you make choices — which holdings your book carries, and when — outcomes still depend on market prices and on the scoring rules, and we make no promise that any choice improves your result. We have measured the relationship between a holder's choices and their finishing position and found it to be very weak. This is substantially a game of chance. Do not pay anything you would mind losing.

The mint is $30, charged in ETH at the rate quoted at the moment you pay. Optional fees during a season: a $50 mid-week unlock, a re-entry priced from the pot and the size of the field, and a season entry of $30. Every fee is optional except the mint, and every fee is final and non-refundable once the transaction confirms, including where a season is later changed, delayed, shortened or abandoned.

Where we are required to refund, we refund in the asset and the amount you actually paid, without interest and without any adjustment for changes in market value or exchange rates since.

By minting you request immediate delivery of digital content and you acknowledge that, once your seat is delivered, you lose any statutory right of withdrawal you would otherwise have.

The rules published on this site apply to the current season. Before a season starts we may change its format, rules, timing, fees, prize (if any) and prize mechanics, including materially.

Once a season has started, a change applies to your seat only where it is needed to comply with law, regulation or a platform requirement; to address security, fraud, abuse or manipulation; to correct an error; to keep the game or its infrastructure running; or where it does not materially reduce what these terms already give you. We will publish notice of any material change on this site.

Our systems and published results are the authoritative record of the game, including books, the prices used, scores, eliminations, re-entries and results. Where something has gone wrong we may correct, void, replay, restate or adjust any result, cycle or outcome, or decline to do so, and our determination is final.

An interruption to the game, the price feed or this site, however long, is not a fault and is not a basis for any claim. Settlement may be delayed. A cycle may be voided. Neither entitles you to a refund of any fee.

We may disqualify a seat, void its results, exclude it from a cycle or a season, and withhold anything otherwise due to it, where we reasonably believe there has been cheating, collusion, manipulation of prices or of the field, use of multiple wallets or identities to gain an advantage, automated abuse, or exploitation of a bug or error in the game, this site or any data feed. We decide what counts as unfair and our decision is final.

A prize is a promotional benefit attached to a seat. It is not what the mint buys, it is not consideration for any fee, and there may be no prize at all.

We may, at our discretion and without liability:

• void or vary a prize where required by law or by a platform;
• substitute a prize of equivalent value, in a different asset;
• restructure how a prize is funded, calculated or delivered;
• withhold a prize entirely in any jurisdiction where offering or paying it would be unlawful, or would impose licensing, registration, reporting or tax obligations we consider disproportionate; and
• require identity, age, residency, sanctions and wallet-ownership checks and tax information before paying anything, and re-award or retain a prize unclaimed 30 days after we ask.

A prize is paid in the asset, by the method and on the timetable we announce, may be reduced by any tax or fee we are required to withhold, and carries no interest. Taxes are yours.

We take 10% of each pot. That is stated in the rules, is fixed in the contract before a season opens, and cannot be raised afterwards.

You are responsible for your wallet, your keys and every transaction you sign. We cannot reverse a transaction, recover a lost key, or recover a seat or a payment sent to the wrong address. Blockchain transactions are final.

We are not liable for any failure, delay, loss or damage caused by anything we do not control, including blockchain networks, wallets, marketplaces, RPC providers, price feeds, hosting and any third-party service. Third-party names and marks that appear here belong to their owners, and their appearance implies no affiliation, endorsement or approval.

You agree not to interfere with or disrupt this site or its infrastructure, attempt to gain unauthorised access to any part of it, submit anyone else's personal data, use automated means to scrape it or place unreasonable load on it, or use it for anything unlawful.

This site and the game are provided “as is” and “as available”. We do not warrant that either will be uninterrupted, error-free or secure, or that anything on this site is accurate or current. We may modify, suspend or withdraw either at any time. This applies equally during a mint and during a season.

Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation. Subject to that:

• we are not liable for indirect or consequential loss, or for loss of profit, revenue, opportunity, data or goodwill;
• our total liability in connection with a seat, a fee or the game is limited to the greater of the mint price you paid for the seat concerned and £100; and
• for anything that was free — a prize, a free season entry, any promotional benefit — our liability is nil, to the maximum extent the law allows.

Nothing here affects statutory rights you have as a consumer that cannot lawfully be excluded or limited.

You may stop taking part at any time; your seat remains yours and remains transferable. We may end or suspend your participation where you breach these terms, or where we are required to. We may end a season, or the game, at any time. If we do, unpaid prizes may not be paid and fees already paid are not refunded.

These terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. This does not take away protections given to you by the mandatory law of the country where you live, and where that law gives you a right to bring proceedings in your own courts, nothing here prevents that.
